BY PURCHASING A STALL RESCUE TOOL, YOU AGREE TO THE FOLLOWING:
INTENDED USE AND MISUSE: The STALL RESCUE TOOL® is designed to provide immediate access to the majority of locked bathroom or partition stall doors, HOWEVER the STALL RESCUE TOOL® will not necessarily open all stall bathroom or partition stall doors. In the event of a medical emergency we recommend dialing 911 immediately before attempting to gain access to the
locked door. Please see the General Specifications below for more information. FURTHER, the STALL RESCUE TOOL® must be used according to its instructions in order to work properly. You understand that we are not responsible for any misuse of the tool, or any failure of the tool to open a bathroom stall. We are further not responsible for any misuse of the tool that leads to breakage or injury.
LIMITED WARRANTY: The STALL RESCUE TOOL® is warranted to be free from defects in material and workmanship and we will replace any STALL RESCUE TOOL® that breaks within ONE YEAR after the date of purchase unless the breakage is related to improper use of the STALL RESCUE TOOL®. You understand that besides the limited warranty above, we provide no warranty, express or implied, as to the use and effectiveness of the STALL RESCUE TOOL®, including without limitation, warranties of merchantability, fitness for a particular purpose, or any warranty as to the effectiveness of the tool in opening any locked bathroom or partition stall doors in an emergency.
LIMITED LIABILITY: Our liability is limited to the refund or replacement value of a STALL RESCUE TOOL®. We are not liable for losses (direct, third party or otherwise) resulting from any damage to persons or property related to use or misuse of the tool, including but not limited to losses related to injuries caused by the tool, injuries resulting from the failure of the tool to open a stall door in a certain amount of time, or damage caused to property resulting from use of the tool. You agree to indemnify us from any losses, including reasonable attorney’s fees, arising from our need to enforce this provision.
GENERAL SPECIFICATIONS: Used properly the STALL RESCUE TOOL® will open the majority of bathroom or stall partition doors. Typical bathroom or stall partition is a bathroom or stall partition door, recognized in its industry of use, which has not been modified either in its architecture or locking system such that it would preclude the designed function of the STALL RESCUE TOOL® from opening the locked door. One example of a modified door would be the installation of a privacy strip that has been installed over the seam of the door. Please note that some manufactures include a privacy strip as part of their door design. The door seam must be wider than approximately 0.160”, which is slightly less than 1⁄4 of an inch, and slightly more than the thickness of two U. S. quarters placed together, to allow enough space for the tool effector arm (the stainless steel rod that is rotatable within the tool handle) to be placed between the door and partition seam. Note: Should you encounter a door seam that is not as wide as the aforementioned door seam width criteria, the door seam may be expanded enough with an appropriate tool, screw driver, pry bar, wedge, etc., if, these types of tools are immediately available and utilized such to allow the user to place the STALL RESCUE TOOL® effector arm through the door seam. In other cases you may find a wider seam at either the bottom of the door seam or the top of the door seam. If this is the case, place the effector arm at this location and then slide the STALL RESCUE TOOL® either down or up to the location of the stall door lock hardware. This “wider seam” may be due to door hinges that have worn enough to cause the door to sag from its originally installed position, or an otherwise damaged door.
